· If you receive a damaged or defective item, you must report the issue within thirty (30) days of delivery by contacting us with your order number and photographs of the damaged or defective product. Upon verification, we will, at our option, provide a replacement, store credit, or a full refund for the affected item(s);
· We will acknowledge and respond to all return and refund requests within ten (10) business days of receipt;
· Opened food products are not eligible for return or refund due to food safety regulations.
11. Promotions, Discounts, and Coupons All promotions on www.oldbarrelspices.com are subject to specific terms and may be modified or canceled at any time.
Improper use of promotions may result in order cancellation.

14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OLD BARREL SPICE COMPANY OR ITS RELATED ENTITIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR PRODUCTS PURCHASED FROM www.oldbarrelspices.com WITHIN THE PREVIOUS NINETY (90) DAYS.
15. Indemnification
You agree to indemnify, defend, and hold harmless Old Barrel Spice Company or its related entities, and their respective officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to:

· Your violation of any applicable law, statute, or regulation; or
· Your infringement or misappropriation of any third-party intellectual property, privacy, or other rights.
Notwithstanding the foregoing, your indemnification obligations under this Section shall not apply to the extent that any claim arises from the Company’s own negligence, willful misconduct, or breach of these Terms.
16. Termination We reserve the right to suspend or terminate your access to www.oldbarrelspices.com at any time without notice.
17. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the State of North Carolina, without regard to conflict of law principles.
Except as provided in Section 18 (Dispute Resolution and Arbitration), any disputes shall be resolved exclusively in the state or federal courts located within North Carolina.
18. Dispute Resolution and Arbitration
Before initiating any formal dispute proceeding, you agree to first contact us at info@oldbarrelspice.com and attempt to resolve the dispute informally for at least thirty (30) days. If the dispute is not resolved within that period, either party may proceed as set forth below.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Site that is not resolved through informal negotiation shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The arbitration shall be seated in Charlotte, North Carolina. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action and Jury Trial Waiver. YOU AND OLD BARREL SPICE COMPANY EACH WAIVE THE RIGHT TO A TRIAL BY JURY. YOU ALSO AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, BOTH PARTIES WAIVE ANY RIGHT TO A JURY TRIAL.
Small Claims Court Exception. Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the jurisdictional limits of such court.
19. Force Majeure
Old Barrel Spice Company shall not be liable for any delay or failure to perform any obligation under these Terms to the extent that such delay or failure is caused by events beyond the Company’s reasonable control, including but not limited to natural disasters, pandemics or epidemics, supply chain disruptions, carrier or shipping delays, acts of government or regulatory authorities, war, terrorism, labor disputes, power failures, or internet or telecommunications outages. In the event of a force majeure occurrence, the Company’s obligations shall be suspended for the duration of the event, and applicable timelines shall be extended accordingly.
20. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in effect.
21. Entire Agreement
These Terms, together with the Privacy Policy (which governs the collection and use of your personal data) and any other policies posted on www.oldbarrelspices.com, constitute the entire agreement between you and Old Barrel Spice Company or its related entities regarding your use of the Site.
